GPS Tracking Legislation

Although there are a number of national associations monitoring the GPS tracking issue, only ISPLA has been actively lobbying GPS legislation, which affects a segment of investigative and security professionals. In fact, one investigative professional association group views our opposing such bills as a "Quixotic" effort. However, ISPLA has successfully lobbied to legalize such investigative techniques before state legislatures. We will take the same measured approach at the federal level, although we admit it will not be easy to achieve similar results. We welcome support from our individual colleagues - by joining ISPLA -- and if possible, financially supporting our efforts.

The U.S. Supreme Court has agreed to rule whether or not police need a warrant to use the Global Positioning System to track the movements of suspects. DOJ will argue a warrant is not needed even if future "scientific enhancements" or an aggregation of devices is used. But the question will be "Can law enforcement use the technology without a warrant in a constitutional way?"

This morning's U. S. Supreme Court order (PDF) agreeing to hear the case asks lawyers on both sides to address the question: "Whether the government violated respondent's Fourth Amendment rights by installing the GPS tracking device on his vehicle without a valid warrant and without his consent." Two U.S. Supreme Court cases decided decades ago (U.S. v. Knotts and U.S. v. Karo) held that police need not obtain court approval to track suspects through a crude radio beeper.

"This (Supreme) Court has held (in Knotts) that a 'search' within the meaning of the Fourth Amendment occurs only where a 'legitimate expectation of privacy' has been invaded by government action. ... As a result, what someone 'knowingly exposes to the public is not a subject of Fourth Amendment protection.'"

ISPLA's hope is that the government's position prevails before the Supreme Court. Should it rule that a warrant is necessary, then it is unlikely we can make our case before Congress for an exception for use of GPS tracking devices in conducting lawful investigations.

Surveillance Tips for Private Investigators

The critical part of a private investigator’s job is doing surveillance. Mostly, these private investigators perform surveillance from their own vehicles. Along the way, these private investigators have discovered some tricks of the trade. Among them are those defined below:

1. A tinted glass is an important feature for a private investigator. Have your vehicle’s windows tinted so you can sit back and be almost unnoticed anyplace you go.

2. When tracking in heavy traffic areas, private investigators must stick on the trailed vehicle’s bumper. As there are too many stoplights and there is heavy traffic in city areas, you must remain very close to the tailed vehicle in order not to lose sight of it.

3. Private investigators sometimes determine a name or an address by checking out the mailbox or peeking at a mail that is sticking out.

4. Private investigators can verify whether residence is a single or multi-family home by the number of electric meters.

5. Private investigators must be very careful when chasing someone. The golden rule is to never lose sight of that person.

6. A private investigator must always have a pen, paper or voice recorder anywhere he or she goes. A pen and paper is important in taking down notes that may be very useful for clients.

7. As it is very tough to to figure out height of an individual – whether male or female – private investigators usually use this trick: you can compare the individual’s height to any object near them. You can use a door perhaps, or maybe even a nearby car (or the ones they are using, for that matter).

8. It is inevitable for private investigators to use a video – however, as a private investigator, you must make sure that there is a date and time stamp on each video. You can correct this on the camera settings. It is advisable to get a panoramic video shot of the person’s location or his / her vehicle for verification purposes.

9. Stake outs can go for several hours so private investigators are advised to be prepared at all times. Prepare foods (protein bars), water or toilet paper in your car.

The family of Ilya Lastovkin, the Stoughton man missing for more than 11 weeks, has a nationally known private investigator working on the case.

Joseph Moura, president of National Investigation Bureau, took on the case Dec. 21.

An investigative consultant with the NBC television show “48 Hours,” Moura has been running his Stoughton-based detective agency for 27 years and has worked on countless missing person cases, including the high-profile disappearance of 3-year-old Madeleine McCann from a resort hotel room in Portugal.

CHARLESTON, W.Va. -- A Putnam County man's efforts to take a picture of a West Virginia State Police cruiser illegally parked behind the Kanawha County Judicial Annex led to a confrontation with a state trooper, according to a lawsuit filed Monday.

In the suit, filed in Kanawha Circuit Court, Michael Kidd alleges that he got out of his car to photograph several cruisers that were illegally parked on Goshorn Street between Virginia and Quarrier streets on Sept. 23. One of the police cars took up two handicapped-parking spaces, according to the suit.

The Granite City School District has been grappling with a rash of accusations of staff misconduct that have alarmed parents and led to the dismissal of one employee so far.

Superintendent Harry Briggs said Wednesday that the number of allegations against employees is unusual and that the district is investigating claims that range from inappropriate sexual contact to drinking with students.

ATLANTIC CITY - A former Hudson County cop-turned-watchdog said Tuesday he had withdrawn his complaint against the city for failing to release public documents.

Richard Rivera, a private investigator who once worked for the police department in West New York, said the city promised it would provide last year's use-of-force reports from the Atlantic City Police Department.

The city initially denied his request in late October after refusing to release the same information to The Press, despite giving five years' worth of data to Rivera in 2008.

City Solicitor Robert Tarver did not return calls for comment Tuesday.

Building a PI Practice to Sell

Most private investigative practices are first generation businesses which are established post law enforcement retirement for the practitioner to remain active, creative, and productive to supplement his/her retirement. Whenever that tenure expires the business becomes obsolete, dormant and ends without realizing any profit for its owner beyond the cash flow generated in the business's life cycle. The client base, reputation, brand identity, recognition and innovation are not capitalized and leveraged for a consummate payday at the end of the owner's involvement in the business.

A private investigative business is a viable entity that has value which can be sold by the private investigator to current management, business competitors or unrelated entrepreneurs looking to enter the industry or expansion of their operation already grounded in it. This will provide resources for the practitioner to supplement retirement, embark on other entrepreneurial endeavors or invest in stocks, bonds, etc., utilizing the interest generated to supplement the lifestyle envisioned post retirement. The determining factor of sale price captured when it is time to sell is dependent on the business operation way before a business is marketed for sale. It may be prudent to structure the entire operation from inception to make it attractive as an acquisition candidate and also structure all expansions, specializations, branding, etc. with the objective of converting the value created into cash from selling the business. This does not negate the selection process of choosing a business entity structure for liability minimization, taxation, specialization dependent on experience, knowledge, aptitude or interest, demographics, but creates a paradigm to create an enterprise which will fulfill the exit strategy of selling the business and capitalizing on the equity both tangible and intangible that was created.

A private investigative business is considered an going concern when it is a viable enterprise satisfying the demands and requirements of current clients and poised for expansion to accommodate future clients. The more attractive its balance sheet, income statement, client roster, tenure of current clients, industry growth potential, innovative acumen and branding, the better the possibility to capture an exit price which the private investigator is satisfied justly compensates the magnitude of risk, effort and sacrifice required to build an investigative practice into a viable business entity worthy of being acquired by others who see its value as an income generating enterprise. However, this value is not static as market and industry conditions are constantly shifting which can have an impact on the ultimate strike price that a business is sold. Tax consequences notwithstanding, most business owners would like to sell their companies for all cash at closing. However, that may not be possible and the owner may have to be flexible in the way the sale is structured to facilitate its consummation by providing seller financing. Below there are a few prerequisite preparations that make a private investigative business attractive for sale.

1. Do establish an area of specialization and competency. This will help to establish your agency as an expert, determine your company's client roster and company's acquisition value. The buyer maybe looking to supplement its other areas of expertise and calculate that it is more cost and time effective to acquire a company already excelling in specialization than to allocate time and resources to develop competency.

2. Do not leave your business vulnerable to liability due to lack of general liability insurance. This can undermine the business you have built and erode its value as a result of litigation and the resources necessary for defense representation.

3. Do keep excellent records of contract and retainer agreements with clients, income statements, balance sheets, tax returns, licensing agreements, etc.

4. Do not cut your prices in a recessionary environment; it creates the image of being a discount operation which will affect the cashflow generated, valuation index and ability to recalibrate prices upward when the industry or market recovers.

5. Do reinvest as much as possible of your cashflow into the business to accelerate growth, this may take the form of adding personnel, equipment, knowledge base, etc.

6. Do consider utilizing adjunct specialized staff to create depth and breadth establishment in specializations, while higher level of competency is being developed internally.

7. Do not skim on marketing at any stage of the business cycle.

8. Do make sure your business is operated in compliance with state licensing and industry standards.

9. When you are ready to sell become knowledgeable of the sale process by consulting a competent attorney who specializing in selling and buying businesses, books on the subject, websites, a business brokers and get an independent appraisal from a reputable third party appraiser.

10. List your business with a reputable Regional or National Business Broker, classified advertisement in PI Magazine to a captive audience or online prominent website which offers high exposure. If possible utilize all three for maximum market visibility.

Private Investigators are in the unique position to be able to facilitate the selling of their businesses by utilizing their investigative knowledge of background checks, asset searches, fraud investigations, due diligence, interviewing, etc. You are able to assess and evaluate the buyer's capacity and intent to consummate the purchase and conduct your own investigation tangent to your legal counsel if necessary to mitigate any potential problems by using good old fashion gumshoe techniques.

First Known Private Investigator

The first known private investigator was a French criminal by the name of Eugène François Vidocq. Vidocq was born in the northern French city of Arras on July 23, 1775 and was the son of a baker. At age 14, Vidocq accidentally killed a fencing instructor who had challenged the young man to a duel over a woman, and Vidocq stole money from his parent’s bakery with the intent of sailing to the Americas. But along the way he lost his money to a young actress and at age 15, joined the Bourbon Regiment, a company of battle-hardened ruffian soldiers. After serving only six months, he boasted to having fought in fifteen duels. His military record reflects a long list of reprimands, desertions and reenlistments according to a ghost-written biography.

Vidocq was in an out of jail through his mid twenties for offenses ranging from a card shark, forgery and as a pirate. At one point in his early life, he masqueraded as a nun and even taught school. That ended when he was run out of town after becoming a little too amorous with some of his older female students.

In the early 1800’s, Vidocq decided to try something more respectable. He approached the Paris police and offered his services as spy. With knowledge of his colorful past, M. Henry, the head of the criminal department of the gendarmerie decided to take a chance on Vidocq. He worked as an undercover informant for the police as an inmate within a Paris prison. Proving his skills, officials orchestrated his escape.

By 1812, he had created the security department within the police called Sûreté, which served as the criminal investigative unit of the Paris police and was later the inspiration for Scotland Yard and the FBI. By 1820, his thirty man unit, many of which were ex-cons, had blossomed into a team of experts that had decreased the crime rate in Paris by 40% and were responsible for more than 800 arrests.

Vidocq is remembered because he introduced record-keeping and ballistics to criminal investigation and made the first plaster casts of shoe impressions. He is credited with creating indelible ink and unalterable bond paper. Vidocq was credit with conducting the first sting operations, plainclothes police work and crime scene preservation. Some of his concepts are still in use today by French police.

Growing bored once again, in 1833, Eugène François Vidocq established the first known private detective agency known as Le Bureau Des Renseignments (Office of Intelligence), again hiring ex-cons. Law enforcement was not impressed with Vidocq’s latest venture and tried many times to shut him down. In 1842, he was arrested on suspicion of unlawful imprisonment, taking money under false pretenses, corrupting public officials, and usurping police functions after he had solved an embezzling case. He was sentenced to five years imprisonment and fined 3,000 francs. Later suspecting that he had been set up, the Court of Appeals released him.

During his later years, he wrote novels based on his criminal experiences. In 1946, there was a film based on Vidocq’s memoirs titled, “A Scandal in Paris”.
When his wife died in September, 1847, he retired and closed his agency. In April 1857, Vidocq became paralyzed in his home in the Marais district in Paris and died on May 11.

The men and women of the OPPOSITION to SB 202 (R- Harman) Private Investigator Continuing Education, are extremely happy to announce that our grass root efforts have been achieved in defeating SB202.

Upon the Opposition learning and announcing that both the California Department of Finance (DOF) and the California Department of Consumer Affairs (DCA), have opposed this bill, SB 202’s fate appears to be sealed to not emerge from the Assembly Appropriations Suspense Calendar.

The Opposition’s ongoing arguments against SB202 have been confirmed by DCA, in that this bill is “unsubstantiated, overly punitive and would significantly increase the workload of BSIS”, and that “this legislation would take away from current enforcement that could better benefit the consumers of the State if California.” The agency went further in saying that “mandating continued educational programs are a burden to working Californian’s without a demonstrated threat to public heath, safety, or welfare and this burden is unreasonable.”

The opposition also received agreement from DOF, who simply stated that SB202 “would establish new requirements, but provides insufficient fees to cover the cost of the program,” despite the bill’s sponsor’s claims, California Association of Licensed Investigators (CALI), that there only a 20K shortfall existed. It was learned that that shortfall was actually 112K short per year, per the DOF’s opposition announcement on July 1st 2009.

Opposition insiders at the state capitol recently revealed that this bill was not going to get beyond the governors desk, despite its overwhelming support in three committees. It all came down to what the opposition predicted from the very beginning…. that the economy, our standing record of good discipline and the lack of funding were going to be the factors behind the final decision of this bill. Although there is a slight chance that the SB202 may be revived next year, the Opposition will remain on watch for the industry. This should never happen again.

The opposition thanks everyone for their participation and support. A grass roots effort of this nature could not have defeated the largest private investigator association in the world without the support of the industry. In the end, it was the INDUSTRY who prevailed. We would also like to extend our thanks to the men and women of the many Professional Associations who supported our grass root efforts especially the Professional Investigators of California Association (PICA) for their timely contributions.

We only hope that the industry is now able to begin to heal and come together from these divisive wounds and hope that everyone in our beloved industry is able to ride this tough economy through and that prosperity will soon shine upon all of us.
